OCASI submitted the following letter in response to the posting of proposed regulatory changes regarding the reporting requirements for "designated foreign nationals" as required by the recent passing of Bill C-31 into legislation. The posting on the Gazette can be found here.
Background
The government has introduced Bill C-31 as a way to reform Canada's refugee determination system. The Bill as written will not protect refugees, but will punish them instead.
On August 13, 2010 the MV Sun Sea arrived on the coast of British Colombia carrying 497 asylum seekers. On October 21, 2010 the federal government introduced Bill C-49: Preventing Human Smugglers from Abusing Canada's Immigration System Act in Parliament. The Bill was introduced as an anti-human smuggling measure. However, the majority of provisions are focused on the treatment of refugees based on their mode of arrival to Canada.
